একটি অ্যাকাউন্ট তৈরি করে, ব্যবহারকারী কনটেন্ট আপলোড করে, AI প্রিভিউ ব্যবহার করে, বা অর্ডার দেওয়ার মাধ্যমে আপনি এই শর্তাবলী মেনে চলতে রাজি হচ্ছেন।

এই শর্তাবলী আমাদের গোপনীয়তা নীতি এবং বিক্রয়ের শর্তাবলীর সাথে মিল রেখে কাজ করে। যদি এই নথিগুলোর বিষয়বস্তু এই চুক্তির সাথে সংঘর্ষে আসে, তবে সেগুলি অগ্রাধিকার পাবে, তবে বাধ্যতামূলক ভোক্তা সুরক্ষা অপরিবর্তিত থাকবে।

• "সরবরাহকারী": একটি যাচাইকৃত উৎপাদন বা পূরণকারী অংশীদার যিনি টেকসই পণ্য বা পরিষেবা অফার করেন।
• "ডিজাইনার": যে কোনো ব্যবহারকারী (ক্রেতা এবং সরবরাহকারী সহ) যিনি সৃজনশীল সম্পদ আপলোড, কনফিগার বা সম্পাদনা করেন।
• "ব্যবহারকারী সামগ্রী": সমস্ত পাঠ্য, লোগো, শিল্পকর্ম, প্রম্পট, 3D মডেল, ভিডিও, বা প্রতিক্রিয়া যা আপনি আপলোড বা তৈরি করেন।
• "এআই টুলস": রিয়েল-টাইম কনফিগারেটর, জেনারেটিভ ডিজাইন বৈশিষ্ট্য এবং প্রিভিউ ইঞ্জিন যা আমরা প্রদান করি।
• "প্ল্যাটফর্ম আইপি": MerchandAise সফটওয়্যার, মডেল, ইন্টারফেস, ডেটাবেস এবং ট্রেডমার্ক।
• "টেকসই মান": পরিবেশগত এবং নৈতিক প্রয়োজনীয়তা যা Merchandaise দ্বারা যোগাযোগ করা হয়।
• "ডিএসএ": ইউরোপীয় ইউনিয়নের ডিজিটাল সার্ভিসেস অ্যাক্ট (নিয়ম (ইইউ) 2022/2065)।
• "জিডিপিআর": ইউরোপীয় ইউনিয়নের সাধারণ ডেটা সুরক্ষা নিয়ম (নিয়ম (ইইউ) 2016/679)।

আপনার বয়স অন্তত ১৮ বছর হতে হবে, অথবা আপনার দেশের আইনি প্রাপ্তবয়স্ক হওয়ার বয়স, একটি অ্যাকাউন্ট তৈরি করার জন্য। অপ্রাপ্তবয়স্করা শুধুমাত্র একটি অ্যাকাউন্টের মাধ্যমে প্ল্যাটফর্মে প্রবেশ করতে পারবে যা তাদের পিতা বা অভিভাবকের মালিকানাধীন এবং যিনি এই শর্তাবলী মেনে নেন।

আপনার নিবন্ধন তথ্য সঠিক এবং আপডেট রাখুন। যখন অনুরোধ করা হবে তখন ব্যবসায়িক ডকুমেন্টেশন (যেমন সংস্থাপন বা ভ্যাটের বিস্তারিত) প্রদান করুন।

আপনার পরিচয়পত্র সুরক্ষিত রাখুন। আপনার অ্যাকাউন্টে সমস্ত কার্যকলাপের জন্য আপনি দায়ী। যদি আপনি অনুমোদিত প্রবেশের সন্দেহ করেন, তাহলে অবিলম্বে আমাদেরকে security@merchandaise.com এ জানান।

আমরা সেই অ্যাকাউন্টগুলো স্থগিত বা নিষ্ক্রিয় করতে পারি যা ক্ষতিগ্রস্ত, নিষ্ক্রিয়, প্রতারণামূলক, অথবা প্ল্যাটফর্মের জন্য অন্য কোনো ঝুঁকি সৃষ্টি করে।

MerchandAise বাজারটি পরিচালনা করে এবং সহযোগিতার সরঞ্জাম সরবরাহ করে। স্পষ্টভাবে উল্লেখ না করা হলে, আমরা প্ল্যাটফর্মের মাধ্যমে বিক্রি হওয়া পণ্যের প্রস্তুতকারক নই।

বাজারে তিনটি প্রধান ব্যবহারকারী ভূমিকা সংযুক্ত করা হয়েছে:

• ক্রেতারা অর্ডার নিশ্চিতকরণে উল্লেখিত সরবরাহকারীর সাথে সরাসরি ক্রয় চুক্তিতে প্রবেশ করেন।
• সরবরাহকারীদের টেকসই মানদণ্ড মেনে চলতে হবে, সঠিক পণ্যের তথ্য প্রদান করতে হবে এবং সময়মতো পূরণ নিশ্চিত করতে হবে।
• ডিজাইনারদের নিশ্চিত করতে হবে যে তারা যে কোনো সম্পদ আপলোড বা তৈরি করেন তার জন্য প্রয়োজনীয় অধিকার তাদের কাছে রয়েছে।

আমরা সৎভাবে বিরোধ নিষ্পত্তিতে সহায়তা করতে পারি, তবে কোনো ফলাফলের গ্যারান্টি দিই না।

প্ল্যাটফর্মটি আইনসম্মত, সম্মানজনক এবং স্বচ্ছভাবে ব্যবহার করুন।

নিষিদ্ধ আচরণ অন্তর্ভুক্ত:

• অবৈধ, মানহানিকর, হয়রানিকর, বৈষম্যমূলক, বা প্রতারণামূলক উপাদান আপলোড বা শেয়ার করা।
• বুদ্ধিবৃত্তিক সম্পত্তি, গোপনীয়তা, বা প্রচার অধিকারের লঙ্ঘন করা।
• ম্যালওয়্যার আপলোড করা, নিরাপত্তা এড়ানোর চেষ্টা করা, বা সাইটের কার্যকারিতায় হস্তক্ষেপ করা।
• আমাদের পূর্ব লিখিত সম্মতি ছাড়া স্ক্র্যাপিং, ডেটা মাইনিং, বা বট ব্যবহার করা।
• পরিচয় ভুল উপস্থাপন করা, অন্যদের নকল করা, বা প্রতারণামূলক কার্যকলাপে জড়িত হওয়া।
• নকল, অরক্ষিত, বা অস্থিতিশীল পণ্য প্রচার করা।

আমরা প্ল্যাটফর্মের সুরক্ষা বা আইন মেনে চলার জন্য প্রয়োজন হলে বিষয়বস্তু মুছে ফেলতে, প্রবেশাধিকার স্থগিত করতে বা কর্তৃপক্ষকে জানাতে পারি।

সরবরাহকারীদের অবশ্যই পরিবেশ-সম্পর্কিত দাবির পক্ষে যাচাইযোগ্য সনদপত্র বা প্রামাণ্য দলিল প্রদান করতে হবে, যদি অনুরোধ করা হয়।

সামগ্রীগুলিকে জৈব, পুনর্ব্যবহৃত, বা অন্যভাবে টেকসই উপাদানগুলিকে অগ্রাধিকার দিতে হবে এবং ইউরোপীয় ইউনিয়ন ও সুইস গ্রাহক সুরক্ষা প্রয়োজনীয়তার সাথে সঙ্গতিপূর্ণ হতে হবে।

ক্রেতারা অর্ডার দেওয়ার আগে টেকসই তথ্যাবলী পর্যালোচনা করতে এবং যেকোনো উদ্বেগ support@merchandaise.com এর মাধ্যমে জানাতে সম্মত হন।

We conduct audits, sampling, and community reporting to uphold sustainability commitments and may suspend Suppliers who fall short.

AI Tools process prompts, logos, and design iterations to generate previews and production-ready files.

By using AI Tools you permit us to analyze inputs and outputs to operate, improve, and secure the services. We do not share your creative assets with third parties for their marketing without consent.

Avoid entering unnecessary personal data. When processing personal data, ensure you have a lawful basis under the GDPR and provide required notices.

AI outputs may need human review. You are responsible for verifying accuracy, compliance, and rights clearance before production.

We log AI activity to satisfy transparency duties under the DSA and to monitor misuse.

When collaboration features are enabled, you grant other users a limited license to view shared User Content.

Suppliers confirm they have the right to use any assets provided by Buyers or Designers. Buyers confirm they have the right to incorporate logos or third-party IP into designs.

We reserve the right to remove or disable access to User Content that appears unlawful or violates these Terms. Repeat infringement may lead to permanent Account closure.

Order pricing, specifications, and delivery timelines appear in order confirmations and the Terms of Sale.

Buyers must review and approve digital proofs or configuration summaries before production starts. Production may begin automatically after the stated approval window.

Payments are processed by secure third-party providers. You authorize us to charge your selected payment method for confirmed orders, taxes, and applicable fees.

Suppliers must meet quality standards, provide tracking details, and honor return or remediation obligations described in the Terms of Sale.

Share fair, constructive reviews based on genuine experiences. Do not post spam, irrelevant content, or incentivized feedback that has not been disclosed.

We may highlight feedback for marketing with attribution limited to a first name or business name unless you opt out.

Community areas are moderated in line with the DSA. We may remove harmful, misleading, or abusive content and may restrict repeat offenders.

We process personal data according to our Privacy Policy, the GDPR, the Swiss Federal Act on Data Protection, and relevant national laws.

Only upload personal data for which you have a lawful basis and have provided necessary notices. Account administrators are responsible for their team members' data.

We assess notices promptly, remove or restrict access when appropriate, and notify affected users unless legally prohibited.

Appeal options are provided where required by the DSA or other applicable legislation.

The Platform integrates third-party payment, logistics, and analytics services. Their terms and privacy notices govern your use of those services.

We do not control third-party availability or security, but we will act on credible reports of risk or misuse affecting our users.

The Platform is provided on an "as is" and "as available" basis. We strive for accuracy and uptime but do not guarantee uninterrupted service or flawless AI outputs. Mandatory consumer rights remain unaffected.

To the extent allowed by law we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

MerchandAise কোনো পরোক্ষ, ফলস্বরূপ, উদাহরণস্বরূপ, বা শাস্তিমূলক ক্ষতির জন্য, অথবা প্ল্যাটফর্ম ব্যবহারের ফলে হারানো লাভ, রাজস্ব, ডেটা, বা সুনাম জন্য দায়ী নয়, যতক্ষণ না প্রযোজ্য আইন অনুযায়ী দায় সীমিত করা যায় না।

Our aggregate liability for all claims under these Terms is limited to the higher of EUR 500 or the total fees you paid to us in the twelve months preceding the claim, unless mandatory law requires a higher amount.

We will notify you of indemnified claims without undue delay and allow you to participate in the defense in coordination with us.

We may suspend or terminate Accounts for material breaches, fraudulent activity, legal requirements, or actions that threaten Platform integrity.

When reasonably possible we provide prior notice and an opportunity to remedy. Immediate suspension may occur when required to prevent harm or comply with law.

You may close your Account at any time via account settings. Outstanding payment obligations and sections intended to survive termination remain in force.

Business users agree to attempt mediation under the rules of the German Institution of Arbitration (DIS). If mediation does not resolve the dispute within 60 days, the matter proceeds to binding arbitration with one arbitrator, seat in Munich, Germany, and English as the language.

EU and Swiss consumers may access the EU Online Dispute Resolution platform or local alternative dispute resolution bodies. Participation is voluntary unless mandatory law requires otherwise.

Nothing prevents you from seeking interim relief or filing claims with competent authorities where permitted by law.

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. Mandatory consumer protections of your residence still apply.

Exclusive forum for disputes with business users is Munich, Germany. Consumers may bring claims before courts in their country of residence or in Munich, as permitted by law.

For cross-border transactions involving Austrian suppliers, the parties may mutually agree to Austrian courts as an alternative venue.

We may update these Terms to reflect legal developments, new features, or security requirements.

Material updates are announced at least 14 days before they take effect via email or dashboard notifications, unless immediate changes are required by law or security needs.

Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

The invalid portion will be replaced with a valid clause that most closely reflects the parties' original intent.
